Terms and Conditions of Sale
ETCH
Updated December 1, 2022 – www.etch-couteaux.com (the “Site”) are published by ETCH, a simplified joint-stock company (SAS) with a share capital of €1,000, whose registered office is at 13 rue du Baigneur – 75018 Paris, registered with the Paris Trade and Companies Register under number 920 468 154, with intra-community VAT number FR35920468154 (hereinafter “ETCH”).
Application of the Terms and Conditions of Sale
The Site is reserved for retail sales to individuals acting for personal purposes (the “Client”). The Client represents and warrants that they are acting as the final consumer of the products they order.
These Terms and Conditions of Sale (the “T&Cs”) apply to and form an integral part of all orders and sales of products and services placed through the Site (the “Products”) with ETCH by the Client. The Client must read the T&Cs prior to placing any order (the “Order”). By placing an Order, the Client fully and unreservedly accepts the T&Cs by clicking on the button “I have read and accept the terms and conditions of sale.”
ETCH reserves the right to adapt or modify these T&Cs at any time. The version applicable to a sale is the one published online on etch-couteaux.com at the time of the Order.
Site Information and Accessibility
etch-couteaux.com is an e-commerce website owned and operated by ETCH. The Site is generally accessible to all Internet users 24/7, except in cases of scheduled or unscheduled maintenance, security needs, or force majeure (as defined below). ETCH cannot be held liable for any damage resulting from the unavailability of the Site. ETCH does not guarantee that the Site will be free from anomalies, errors, or bugs, or that it will operate without interruption. It may, at its sole discretion, determine periods of unavailability of the Site or its content. ETCH cannot be held liable for transmission errors, connectivity issues, or network unavailability. ETCH reserves the right to evolve the Site for technical or commercial reasons. If these modifications do not substantially and negatively affect service provision, the Client may be informed but is not required to accept them.
Registration on the Site
To place an Order, the Client may register on the Site by creating an account containing their information (the “Account”). Registration is validated by ETCH after verification of the standard form completed by the Client. The Client will receive a confirmation email.
The Client must ensure that the information provided is accurate and complete and must update it as necessary. In case of incorrect delivery details, ETCH cannot be held responsible for failure to deliver Products. By registering, the Client represents and warrants that they are of legal age and have the capacity to enter into contracts. ETCH may delete the Client’s Account at any time, for any reason, at its sole discretion, without liability.
Products
Products offered for sale are those described on the Site at the time of consultation, subject to stock availability. Information is updated in real time, but errors may occur, which ETCH cannot be held responsible for.
ETCH ensures accurate presentation and description of Products, but photos, graphics, and descriptions are indicative only. Slight differences in appearance may occur due to screen settings or lighting during photography. Clients may receive previously returned items. Only intact, unused Products are accepted for return.
Orders
Orders on the Site follow the procedure established by ETCH, consisting of steps leading to confirmation. Clients may select Products according to normal consumer needs. Products are added to a shopping cart (the “Cart”) summarizing chosen Products, prices, and fees. Clients can modify the Cart before confirming the Order. By confirming the Order and clicking “I have read and accept the terms and conditions of sale,” the Client accepts the T&Cs, purchased Products, their prices, and associated fees. ETCH sends a confirmation email summarizing the Order. The Client expressly agrees to the use of email for Order confirmation. Invoices are available in the “My Account” section of the Site.
Refusal to Process an Order
ETCH may withdraw any Product from the Site, or modify any content, at any time. It may refuse to process an Order after sending the confirmation email, without liability for consequences. Orders from Clients with prior disputes or suspected fraud may be refused. ETCH strictly prohibits professional use of the Site for resale purposes and may refuse Orders that exceed normal consumer needs.
Prices and Payment Terms
Product prices are shown in euros, including VAT, but excluding customs duties and other taxes, which the Client must pay directly to the carrier. Prices include French VAT and may change at any time, but Products are billed at the price at the time of Order and payment, subject to availability.
Payment is due at the time of Order via Shopify, a secure payment platform. ETCH does not access payment data, which is processed directly by Shopify. Transactions are analyzed for fraud, which may result in blocking certain Orders. Clients authorize debit of their account for the Order total. If payment fails, ETCH sends a notification of cancellation. Order records (excluding payment data) constitute proof of the transaction, and Shopify’s records serve as proof of financial transactions.
Delivery
Delivery refers to the transfer of physical possession of Products to the Client. Delivery is made to the Client’s address, a person of their choice, or a legal entity. Applicable Delivery fees are those indicated on the Site at the time of Order.
When ETCH handles delivery, risk of loss or damage transfers to the Client upon delivery. If the Client arranges delivery, risk transfers upon handover to the carrier. Delivery services include Chronopost, La Poste, and DPD.

Maximum delivery: 12 business days in Metropolitan France, 20 business days internationally.

From November 23 to December 31, delivery may be delayed by 10 additional days due to volume.
Clients must provide complete and accurate delivery details. If Delivery is delayed, the Client may request cancellation and a refund within 30 days. ETCH is not responsible for delay-related damages; only product refund applies.
If Delivery cannot be completed due to incorrect address or failure to pick up at the selected point, no reshipment is possible, and the Client will be refunded within 10 days.
Right of Withdrawal – Returns and Refunds
9.1. Withdrawal Period and Procedure
Under Article L.221-18 of the Consumer Code, the Client has 30 days from receipt to exercise the right of withdrawal without reason. Beyond 30 days, the sale is final. Withdrawal can be exercised by mail to ETCH – 13 rue du Baigneur – 75018 Paris, France or email hello@etch-couteaux.com. Products made to specifications, used, damaged, or unsealed are not eligible.
9.2. Return Procedure
The right of withdrawal is exercised without penalty. The Client returns the Product at their expense; ETCH reimburses within 30 days from notification. Products must be returned in their original packaging, unused and in new condition.
9.3. Refunds
Refunds are issued within 14 days of notification, using the same payment method. If expired, the Client must update the method. ETCH is not liable for delays. Return shipping costs are borne by ETCH only if the Product is incorrect or damaged.
Warranties – Limitation of Liability
10.1. Limitation of Liability
ETCH’s liability is limited to the purchase price of the Product. ETCH is not liable for indirect or consequential losses (lost revenue, profits, contracts, data, time, image, moral damages, etc.).
Products are only warranted to meet contractual terms:

Conforming to description and features.

Suitable for typical intended use.

Meeting reasonable quality and durability standards.
Legal guarantees cover defects of conformity (Consumer Code L217-4 et seq.) and hidden defects (Civil Code 1641 et seq.), allowing free returns of defective Products. Modifications, repairs, or client-integrated Products are excluded.
Hidden Defects: Claim within two years of discovery. ETCH may refund fully or partially, depending on whether the Client retains the Product. Legal guarantees do not replace withdrawal rights (Article 9).
Force Majeure
ETCH is not liable for non-performance due to force majeure, including strikes, riots, war, terrorism, natural disasters, epidemics, transport disruption, system failures, legal changes, or other circumstances beyond control. Obligations are suspended without compensation; if >3 months, the transaction may be terminated by either party without compensation.
Retention of Ownership
ETCH retains full ownership of Products until full payment is received, including principal, fees, taxes, and contributions.
Partial Invalidity
If any T&C provision is deemed invalid, the remaining provisions remain fully effective.
Non-Waiver
Tolerance, inaction, or inactivity by ETCH does not constitute a waiver of rights.
Governing Law – Jurisdiction – Mediation
Sales are governed by French law. Mandatory consumer protection laws of the Client’s country may apply for foreign consumers.
For disputes, Clients may contact hello@etch-couteaux.com or use the EU online dispute resolution platform: https://ec.europa.eu/consumers/odr/. Jurisdiction lies with the competent courts of the Paris Court of Appeal or, for consumers, any legally competent tribunal.
